
Since 2019 the British Virgin Islands (BVI) have adopted the Economic Substance (ES) regulations under the pressure of the European Union (EU). They apply to some specific activities (the “relevant activities”) which most people would use the BVI for (ie: holding companies).
Any company or limited partnership has to show that either:
- it has an economic substance in the BVI (ie: local employees and/or local managers)
- or it is tax residence somewhere else than the BVI.
It would make no sense (at least to most people) to hire local employees just for the sole purpose of creating an economic substance in the BVI. Although some big corporations might do this (a big thanks to the EU for boosting the local BVI economy!).
The only option left is to show tax residence from somewhere else than the BVI.
The International Tax Authority (ITA) of the BVI je odgovoran za ispitivanje takve deklaracije prema pravilu 3:
(a) Potvrde ili pisma izdana od strane nadležnog poreznog tijela druge jurisdikcije;
(b) porezne procjene, zahtjeva, ili dokaz o uplati izdat od strane nadležnog poreznog tijela druge jurisdikcije;
(c) porezne prijave podnesene nadležnom poreznom tijelu druge jurisdikcije;
ili
(d) rješenja izdana od strane nadležnog poreznog tijela druge jurisdikcije.
Ako se tvrtka BVI treba registrirati kao tvrtka poreznog rezidenta u jurisdikciji drugoj od BVI, zatim uopće nema smisla uključivati se u BVI, lokalna tvrtka u toj drugoj jurisdikciji je jasnija…
BVI = najbolje lakirani otoci.
